A Court of Appeal decision
that allows holidays to be sold without consumer protection
could have huge implications for UK holiday makers.
What
is the decision?
Basically
it means that holidays that are sold as individual components
i.e. flights and hotel are sold seperately, as opposed
to a package holiday are not covered by the EU Package
Travel Directive
What
does this mean?
Holiday
companies are likely to try and sell more "dynamic"
packages. Certainly Tui (formerly Thomson) have said
they will sell fewer package holidays.
What
are the implications?
If
the airline that you travel on holiday with then you
will have to make your own way home and if you need
to take legal action against a hotel then rather than
the legal action taking place in the UK as it currently
does, it would have to take place in the country you
were in.
